Adam V. The State,
MLD 2017 356 · Balochistan High Court
This case is from the Balochistan High Court, deciding a criminal revision petition filed by Adam, a truck driver convicted of transporting liquor in violation of the Prohibition (Enforcement of Hadd) Order, 1979. Police had stopped his truck and found 52 sacks containing thousands of cans of beer and dozens of bottles of whisky. Two other men in the truck fled, but Adam, the driver, was arrested. He was convicted by a trial court and sentenced to two years' imprisonment plus a fine, and this was upheld on appeal.
The High Court reviewed the evidence and agreed that the prosecution had proven Adam was in possession of the contraband, since police witnesses gave consistent testimony, there was no evidence of a false implication motive, and lab tests confirmed the substances were alcoholic. However, the court noted a key flaw: although thousands of cans and bottles were seized, only one bottle of whisky and one can of beer were actually sent for chemical testing. Since the rest were never tested, the court held that only those two tested items could be legally treated as proven contraband for sentencing purposes.
Because of this gap in the evidence, the High Court reduced Adam's sentence from two years to time already served, while keeping the fine intact. This case matters because it illustrates an important evidentiary principle: prosecutors must scientifically test a representative and sufficient sample of seized contraband, not just a token portion, to justify a conviction for the full quantity.
