Shahid Dada V. The State,
MLD 2017 288 · Balochistan High Court
This case is about a man named Shahid Dada who was convicted by a trial court in Lasbella, Balochistan for possessing three kilograms of charas (hashish), a violation under the Control of Narcotic Substances Act, 1997. He was sentenced to four years in prison plus a fine. He appealed to the Balochistan High Court.
The High Court overturned his conviction and acquitted him, citing several serious flaws in the prosecution's case. First, although police claimed the drugs were found in a populated area, no independent or private witness was called to observe the recovery, as normally required. The court said police must at least show they tried to find such witnesses, which they did not. Second, there was an unexplained delay of nearly seven months before the seized drug sample was sent for chemical testing, far beyond the legally required 72 hours, raising doubts about whether the sample was tampered with or replaced. Third, the way samples were taken from three separate packets and mixed together made it impossible to know which packet the tested sample actually came from.
The court emphasized that even a single significant doubt in the prosecution's case is enough to acquit an accused person. Because of these combined problems, the court ruled that the prosecution had not proven its case beyond reasonable doubt, and set aside the conviction and sentence.
This case highlights the importance of proper procedure, chain of custody, and independent verification in narcotics prosecutions to protect against wrongful convictions.
