Rahim Muhammad alias Rohi Muhammad V. Syed Noor Shah,
MLD 2017 2106 · Balochistan High Court
This case was a dispute over unpaid rent following an earlier eviction case. Syed Noor Shah, the landlord, had previously won an eviction case against his tenant, Rahim Muhammad, over a rented cabin in Quetta, a decision upheld all the way to the Supreme Court. The Rent Controller had noted in that earlier ruling that the landlord could separately approach a civil court to recover unpaid rent at Rs. 16,000 per month from June 2007 onward. The landlord then filed a civil suit for recovery of arrears amounting to over 1.4 million rupees, and the trial court partially decreed the suit in his favor for about 1.39 million rupees.
The tenant appealed, arguing there was no documentary proof of the rent rate, that the rent amount had never been properly determined, and that the claim was time-barred under the Limitation Act.
The Balochistan High Court rejected these arguments. It held that the rent rate and landlord-tenant relationship had already been conclusively determined by the Rent Controller and upheld through the Supreme Court, so they could not be re-litigated in a civil suit. It also ruled that the three-year limitation period under Article 110 of the Limitation Act had not expired when the suit was filed. Finding no error in the trial court's evaluation of evidence, the High Court dismissed the appeal and upheld the recovery decree.
