Ibrahim Shah V. Pervez Rana,
MLD 2017 1941 · Balochistan High Court
This case is from the Balochistan High Court and involved a civil dispute over damages for malicious prosecution. Ibrahim Shah had been accused in a criminal FIR filed by Pervez Rana, alleging that Shah and others had demolished a wall on Rana's property and committed related offences. Shah was tried and eventually acquitted by the criminal court, but only on the benefit of the doubt, not because he was found innocent outright. Following his acquittal, Shah filed a civil suit seeking Rs. 36,00,000 in damages, claiming the criminal case had been maliciously and falsely filed against him, causing him financial loss, mental torture, and damage to his reputation. The trial court dismissed his suit, and he appealed to the High Court.
The High Court upheld the dismissal. It explained that to win a malicious prosecution case, a plaintiff must prove three things: that the prosecution ended in his favor, that the defendant acted with malice, and that the defendant had no reasonable or probable cause for initiating the case. Simply being acquitted—especially on benefit of the doubt rather than a clean finding of innocence—is not enough to prove these elements. Since Shah failed to provide sufficient evidence of malice or absence of reasonable cause, his claim failed.
This case matters because it clarifies that acquittal in a criminal case does not automatically entitle a person to damages in a related civil suit; separate and specific proof of malicious intent and lack of cause is required.
