Naseebullah Khan V. Abdus Samee Babar,
MLD 2017 1894 · Balochistan High Court
This case involved a civil suit where a government customs official sued a businessman for 5 billion rupees in damages, claiming the man had held a press conference making false, defamatory allegations against him that were published in several newspapers and aired on television. The defendant denied making any defamatory statements and contested the suit.
During the trial, the defendant submitted a list of witnesses but failed to produce them on the scheduled dates. The trial court closed his right to present evidence and, without properly examining the plaintiff's evidence or recording any reasons, decreed the full 5 billion rupee claim against him under procedural rules governing adjournments.
The Balochistan High Court found this approach improper. It clarified that under the Civil Procedure Code, a court asked to "decide the suit forthwith" must still base its decision on the evidence actually on record - it cannot simply decree a case as a penalty for a party's absence without reasoning or evaluation of proof. Given the enormous sum involved, the court held that the defendant was not given fair opportunity to present his case or record his statement, and the trial court's decree lacked any discussion of evidence or justification.
As a result, the High Court set aside the trial court's judgment and decree and sent the case back for a fresh decision, ensuring both parties get a proper hearing based on evidence rather than procedural technicalities.
