MLD 2017 1808 · Balochistan High Court

This case involved an appeal against the acquittal of four men accused of murdering a teenage boy, Zafarullah, whose throat had been cut near a watercourse in Balochistan in September 2014. When the crime was first reported, the killers were unknown, and the FIR named no suspects. Eleven months later, the boy's father suddenly gave a new statement naming the respondents as the killers, based on two "eyewitnesses" who claimed to have seen the murder happen but had never come forward before.

The trial court acquitted the accused, and the father appealed. The Balochistan High Court upheld the acquittal, finding the prosecution's case deeply suspicious. The court noted that genuine eyewitnesses would not stay silent for eleven months, especially when they claimed to be relatives of the victim, did nothing to stop the attack, never reported it, and did not even help move the body to a hospital. This unnatural, unexplained delay suggested the witnesses had been "planted" later after deliberation, rather than being truthful accounts of what actually happened.

The court reaffirmed a basic principle of criminal law: the prosecution must prove guilt beyond reasonable doubt, and any doubt must benefit the accused. Since the evidence here was unreliable and uncorroborated, the doubt could not be resolved against the accused. This case illustrates how courts scrutinize delayed evidence and witness credibility, protecting individuals from convictions based on suspicious, after-the-fact testimony.
