Haji Muhammad Umar V. Taj Muhammad and another,

MLD 2017 1691 · Balochistan High Court

This case involved a dispute over a sale of buffaloes between two parties in Quetta. The complainant, Haji Muhammad Umar, alleged that Taj Muhammad, along with his brothers, had issued him four cheques as payment for the buffaloes, but the cheques bounced due to insufficient funds. A criminal case was filed under Section 489-F of the Pakistan Penal Code, which deals with dishonestly issuing a cheque that gets dishonoured.

The trial court initially convicted Taj Muhammad while acquitting his brothers. However, on appeal, the Additional Sessions Judge overturned this conviction and acquitted him too. The complainant then challenged this acquittal before the Balochistan High Court.

The High Court examined the evidence and found that the cheques had actually been presented to the bank about two years after they were issued, far beyond the legally required six-month window for cashing a cheque. A written agreement (iqrarnama) between the parties did not even mention these cheques. The court also noted there was an ongoing civil dispute between the parties, raising doubts about whether the criminal case was filed to pressure the accused rather than to pursue a genuine criminal complaint.

Applying the principle that acquittals carry a double presumption of innocence and should not be overturned unless clearly flawed, the High Court found no such flaw here. It dismissed the appeal, upholding the acquittal. The case highlights how courts scrutinize the timing and context of cheque-related criminal complaints to prevent misuse of criminal law for
