Noor Ahmed and another V. Deputy Commissioner, Kharan and 3 others,

MLD 2017 1660 · Balochistan High Court

This case involved a dispute over residency status affecting a medical college admission. The petitioners, a girl seeking admission to Bolan Medical College and her father, had obtained local certificates confirming they were permanent residents of Kharan district in Balochistan. After the petitioner scored first on the merit list for the entrance test, the Deputy Commissioner of Kharan cancelled the family's local residency certificates based on a recommendation, effectively disqualifying her for admission on the basis that she was not actually a local resident.

The petitioners challenged this cancellation in the Balochistan High Court, arguing they had been condemned without a hearing and that the cancellation was driven by malicious intent to benefit another candidate who ranked lower on the merit list.

The court found that the petitioners had strong evidence proving generations-long residency in Kharan, including old identity cards issued to the petitioner's father and mother decades earlier, and an existing local certificate issued to the petitioner's brother in 1994. The court also noted that official notices had been sent to an address where the petitioners did not live, suggesting an intentional effort to cancel their certificates without their knowledge. The court concluded that authorities acted illegally and in haste, without due process.

The court set aside the cancellation order and restored the petitioners' local certificates. This case highlights the importance of due process and protects citizens from arbitrary denial of identity and residency rights, especially when it affects access to education opportunities.
