Mir Shah Nawaz Marri V. Sub-Registrar, Quetta and 2 others,
MLD 2017 158 · Balochistan High Court
This case involved a dispute over a power of attorney allegedly signed by a woman authorizing someone else to act on her behalf regarding property. She later sued to have the document cancelled, claiming it was based on fraud and misrepresentation and that she never actually signed it or appeared before the Sub-Registrar to have it registered. The trial court and the first appellate court both ruled in her favor, cancelling the power of attorney. The person who relied on the document then challenged these decisions before the Balochistan High Court.
The High Court upheld the lower courts' rulings. It explained that while registered documents normally carry a presumption of correctness, this presumption weakens once the person disputes having signed it. In such cases, the party relying on the document must properly prove its execution, including producing the attesting witnesses who saw the signing happen, not just witnesses who can identify a signature. Here, the side defending the power of attorney failed to produce the Sub-Registrar as a witness, failed to bring both marginal witnesses, and could not prove the woman actually appeared before the Sub-Registrar or signed the document herself. Because of these gaps, the court found the document unproven and upheld its cancellation.
This case highlights how important proper proof and witness testimony are for validating legal documents like powers of attorney, and it reinforces protections against fraudulent use of such documents, especially in family property disputes.
