Muhammad Khan and another V. Additional Sessions Judge, Chaman and others,
MLD 2017 1508 · Balochistan High Court
This case concerns a woman, Bibi Khatima, who died under suspicious circumstances after her marriage. Her family members, including her cousin and her father, believed she had been murdered by her husband and his relatives using firearms, and that she was buried hastily without informing her family. They approached an Additional Sessions Judge acting as an "ex-officio Justice of Peace" under the Criminal Procedure Code, asking him to direct the police (Levies) to register a First Information Report (FIR) against the accused. The Judge refused, partly because a separate FIR had already been registered against the deceased's own brother regarding the same incident. The family then challenged this refusal in the Balochistan High Court.
The High Court ruled in favor of the petitioners. It held that under the law, when someone reports a cognizable offence like murder, the police are legally obligated to record an FIR - they have no authority to first investigate whether the complaint is true before registering it. Similarly, a Justice of Peace's role is limited to checking whether the information describes a cognizable offence; if it does, they must simply direct the police to register the FIR, without assessing the truth of the allegations. The Additional Sessions Judge had wrongly gone beyond this limited role, so his order refusing registration was declared unlawful and set aside.
This judgment matters because it reinforces that citizens have a right to have serious criminal complaints formally recorded by police, and that officials cannot block this basic step by prejudging the merits of a case.
