Ghulam Murtaza V. The State ,

MLD 2017 1235 · Balochistan High Court

This case concerns Ghulam Murtaza, convicted by an Anti-Terrorism Court in Quetta for kidnapping, raping, and murdering a ten-year-old girl, Shagufta Paracha, who disappeared while running an errand to a local shop. He was sentenced to death for the murder and for rape, and to life imprisonment for the kidnapping, along with a fine to be paid to the victim's family. He appealed to the Balochistan High Court against these convictions and sentences.

The High Court examined the evidence, which included no eyewitnesses to the crime itself, but relied on a chain of circumstantial evidence: the accused's own confession recorded before a magistrate, his disclosure to private witnesses that led police to recover the rickshaw used in the abduction, the victim's clothes, a seat cover, and the knife used as the murder weapon. Forensic testing confirmed human blood on both the rickshaw and the knife. Medical evidence showed the girl had been sexually assaulted and killed by strangulation weeks before her body was found.
