Wali Muhammad V. Abdul Wahid and 3 others,
MLD 2016 966 · Balochistan High Court
This case from the Balochistan High Court involved a dispute over an official government residential quarter in Zhob. Abdul Wahid claimed he was the lawful allottee of the quarter based on an allotment order from 1999. Government authorities later declared that order fake and tried to cancel it and evict him, but he sued and won a declaration from the trial court confirming his right to the property. Wali Muhammad, who had also been allotted the same quarter, challenged this decree, arguing it was obtained through fraud and misrepresentation, since the underlying allotment document had already been found bogus and a criminal case had been registered against Abdul Wahid. Lower courts rejected this challenge.
The High Court found serious problems with how the original suit was handled. It noted that since the suit involved the government, the law required a 90-day notice period before proceedings could continue, but the trial court decided the case within two months, violating this rule. The court also held that the government had no authority to permanently transfer ownership of official residential buildings to individuals, meaning the plaintiff never had a valid legal claim to begin with. The High Court set aside all the lower court decisions, dismissed the original suit, and directed the government to review the status of public buildings, prevent illegal permanent allotments, and hold responsible officials accountable for failing to protect public property during the case.
