This case involves a bail-before-arrest application from seven applicants accused in a violent altercation in Chaman that resulted in one death and several injuries. The Balochistan High Court found that, given the cross-versions of the incident and the doubtful evidence, the case required further inquiry rather than immediate arrest. It held that mere absconding is not enough to deny bail if the case genuinely raises doubts, and that possible false implication due to malice could not be ruled out. The court granted pre-arrest bail to the applicants, emphasizing fairness when both sides of a violent dispute file competing criminal complaints against each other.
یہ مقدمہ چمن میں پیش آنے والے ایک پرتشدد جھگڑے کے سلسلے میں سات درخواست گزاروں کی جانب سے دائر کردہ ضمانت قبل از گرفتاری کی درخواست سے متعلق ہے، جس کے نتیجے میں ایک شخص ہلاک اور کئی افراد زخمی ہوئے تھے۔ اسی واقعے کے حوالے سے دو حریف فریقین کی جانب سے دو مختلف ایف آئی آرز درج کرائی گئیں، جن میں ہر فریق نے دوسرے پر پہلے حملہ کرنے کا الزام عائد کیا۔ ایف آئی آر نمبر 32 کے تحت درخواست گزاروں پر یہ الزام تھا کہ انہوں نے حاجی داد محمد نامی شخص کو قتل کیا اور دیگر افراد کو زخمی کیا۔ جبکہ ایف آئی آر نمبر 33، جو مخالف فریق کی جانب سے درج کرائی گئی تھی، میں اصل مدعی اور اس کے رشتہ داروں پر یہ الزام لگایا گیا کہ انہوں نے درخواست گزاروں اور ان کے رشتہ داروں پر حملہ کیا۔
