Jamal Khan V. Secretary Home Department and 6 others,
MLD 2015 972 · Balochistan High Court
This case involved a long-running land dispute in Zhob, Balochistan. The petitioner, Jamal Khan, claimed that other parties had forged an arbitration agreement from 2000 by falsely putting his thumb impression on it, and that this forged document was later used in court proceedings. He asked a Sessions Judge, acting as Justice of the Peace, to order police to register a criminal case (FIR) against the other parties for cheating and forgery. The Sessions Judge refused, and Jamal Khan challenged that refusal before the Balochistan High Court.
The High Court upheld the dismissal. It found that the real issue was a civil dispute over partition of shared (Shamilat) property, and that the petitioner was trying to turn this civil matter into a criminal case simply to keep possession of a piece of land. The court noted that the petitioner waited 13 years after the agreement was signed before alleging forgery, and that none of the other people who signed the agreement supported his claim. Since the law already provides a specific remedy for challenging arbitration agreements or awards, through the Arbitration Act, the petitioner should have pursued that civil remedy rather than seeking criminal proceedings.
The case matters because it reinforces that courts will not allow criminal law, particularly FIR registration, to be misused as a tool for resolving essentially civil property disputes when proper civil remedies exist.
