Imdad Ali V. The State,
MLD 2015 176 · Balochistan High Court
This is a criminal appeal decided by the Balochistan High Court. Imdad Ali had been convicted by a trial court for murder (under section 302(b) read with section 34 of the Pakistan Penal Code, which deals with acts done with common intention) and sentenced to life imprisonment plus a fine, for allegedly helping another man, Bahadur Khan, who shot and killed Faqir Muhammad. The prosecution's case was that Bahadur Khan fired the fatal shot while Imdad Ali stood nearby with a running motorcycle, then both fled together.
The High Court found serious problems with the evidence. The only eyewitness testimony merely showed that Imdad Ali was present at the scene and left with the shooter afterward—it did not prove he shared a common intention to commit murder. The court noted that mere presence at a crime scene is not enough to convict someone under the "common intention" provision; there must be clear proof of shared intent. The court also found that a supposed "disclosure" statement by the accused didn't reveal anything new, since police already knew those facts from the original complaint, so it couldn't count as valid evidence of discovery. Relying on established Supreme Court precedents, the judges ruled that the prosecution failed to prove guilt beyond reasonable doubt and acquitted Imdad Ali, ordering his release.
This case matters because it reinforces the principle that criminal liability cannot rest on mere presence or association with an offender—concrete evidence of shared criminal intent is required.
