MLD 2015 1627 · Balochistan High Court
This case involved a family dispute over property and money in Quetta. The respondents' predecessor had allegedly agreed to buy a house from the appellant for Rs. 34 lakhs, paying most of the price upfront, but before the property could be formally transferred, he was murdered. His legal heirs then sued the appellant, seeking to be declared owners of the house, to have it transferred and possession handed over, and to recover Rs. 11 lakhs they claimed was separately invested in the appellant's fruit business. The appellant denied owing anything, claiming the original purchase agreement had been mutually cancelled and only a smaller forfeited deposit was ever paid.
The trial court had decreed the suit in favor of the respondents, and the appellant appealed. Rather than deciding who was right on the facts, the Balochistan High Court found a basic procedural flaw: the trial court had never properly framed the necessary legal and factual issues arising from the parties' pleadings, as required by the Civil Procedure Code. The High Court held that this was the trial court's own duty, regardless of whether the parties raised it, and that a court's failure to do its job should not unfairly harm any party's case.
As a result, the High Court set aside the trial court's judgment and sent the case back for the issues to be properly framed and decided afresh. This case underscores that courts must independently ensure procedural fairness, since parties should not suffer for a judge's oversight.
