MLD 2015 1468 · Balochistan High Court

This case involved a property dispute in Balochistan over who was responsible for repaying a large sum of "pagri" (premium money) paid by a tenant.

The original owners of a building called Asmat Plaza received Rs. 5,50,000 from a tenant as pagri for a shop, then rented it to him at a nominal Rs. 500 per month. The owners later sold the entire building, including this shop, to a new buyer. The new owner then sought to evict the tenant. Eviction proceedings went all the way to the Supreme Court, which upheld the eviction and confirmed that the tenant had indeed paid the pagri, but left it to the tenant to separately sue for recovery of that money. The tenant then filed a recovery suit against both the original sellers and the new owner. The trial court ordered the original sellers to repay the amount, prompting this appeal.

The Balochistan High Court held that when the new owner bought the property, he took it with full knowledge of the pagri liability, which is why he paid a reduced price. Under the law governing sale of property, a buyer who purchases with knowledge of encumbrances becomes responsible for them once ownership transfers, and the sellers cease to have any further liability. Since the new owner also benefited from evicting the tenant, he alone was liable to repay the pagri, not the original sellers.

The court partly accepted the appeal, ruling that the new owner must pay the tenant, not the original sellers. This case clarifies how liabilities attached to a property pass to a buyer who knowingly purchases with encumbrances.
