Muhammad Ayaz Khan Jogezai and 2 others V. Government of Pakistan States and Frontier Regions Division, Islamabad and 31 others,

MLD 2015 1220 · Balochistan High Court

This case concerned recruitment into the Federal Levies Force in Balochistan. The provincial government had advertised about 3,000 vacancies, but the petitioners challenged this, arguing that appointments were being made under outdated 1954 Instructions issued by the Federal Government, which conflicted with constitutional guarantees of equality, non-discrimination, and fair employment opportunities under Articles 25, 27 and 33. They also argued the old rules relied on consultation with tribal sardars, even though Balochistan had abolished the sardari (tribal chief) system through a 1976 law.

During hearings, both the provincial Advocate-General and federal counsel conceded that the 1954 Instructions were outdated and impractical, and that no proper service rules existed for the Levies Force, making transparent recruitment difficult.

The Balochistan High Court acknowledged that Balochistan faced severe security challenges, including terrorism, target killings, and bomb blasts, creating an urgent need for more manpower in law enforcement. Recruiting local youth, the court noted, would both improve security and provide employment opportunities.

Since no valid rules existed, the court did not stop recruitment altogether. Instead, it allowed the provincial government to proceed on a temporary, stop-gap basis using a proposed recruitment formula, while laying down specific terms and conditions for making these appointments fairly until proper rules were framed. This ensured urgent recruitment could continue without violating constitutional principles.
