Muhammad Rasool V. Abdul Ghafoor,
MLD 2014 95 · Balochistan High Court
This case is about a lawsuit for damages brought over a criminal complaint. Abdul Ghafoor had sued Muhammad Rasool in a property dispute. During that earlier civil case, Rasool claimed he had bought the property through a sale agreement, but when the court asked him to produce it, he said Ghafoor had snatched it from him, and he filed a police FIR accusing Ghafoor of theft. Ghafoor was later acquitted in that criminal case. He then sued Rasool for damages, claiming the FIR was false and malicious, ruining his reputation and causing him mental suffering. The trial court partly agreed and ordered Rasool to pay Rs. 800,000.
Rasool appealed to the Balochistan High Court. The High Court found that the trial court had wrongly relied on documents that were never properly presented or proven as evidence during the trial, and Rasool never got a chance to cross-examine on them. The High Court explained that to win a malicious prosecution case, a plaintiff must prove several things: that he was prosecuted, that there was no reasonable or probable cause for it, that the defendant acted with malice, and that the case ended in his favor causing him real damage.
