Zafar Iqbal V. Moula Dad and 3 others,
MLD 2014 911 · Balochistan High Court
This case involved a property dispute in Quetta. Zafar Iqbal claimed he owned a plot of land, but alleged that someone had forged a power of attorney in his name and used it to fraudulently sell his property, which was then transferred through a sale deed and recorded in official mutation records in favor of another person. The trial court dismissed his lawsuit, partly because he hadn't specifically asked for cancellation of a second power of attorney that the defendant mentioned during the case.
The Balochistan High Court overturned this decision. It found that courts can grant necessary relief even if not specifically requested, especially to do complete justice. Crucially, the defendant never actually produced the original power of attorney in court, nor proved it was lost or destroyed, which are legal requirements before a copy can be used as evidence. Since these conditions weren't met, the photocopied power of attorney was inadmissible and couldn't prove any transfer of ownership. The court also noted no witnesses to the document were presented.
Finding the trial court's judgment was based on misreading of evidence and reliance on legally inadmissible documents, the High Court ruled in favor of Zafar Iqbal, declared him the rightful owner, and cancelled the fraudulent sale deed and mutation entries.
This case matters because it reinforces an important evidence law principle: parties cannot rely on copies of crucial documents like powers of attorney without proving the original was genuinely lost, destroyed, or unavailable, protecting property owners from fraud based on unverified paperwork.
