Saadullah and another V. Secretary, Irrigation Department,
MLD 2014 19 · Balochistan High Court
This case involved a land dispute between two petitioners and the Irrigation Department in Balochistan. The petitioners claimed ownership of land in Ziarat district where the government intended to construct a Delay Action Dam. They filed a civil suit seeking a declaration of ownership and a permanent injunction to stop the department from taking the land without following proper legal acquisition procedures.
The trial court examined the case and, based on preliminary legal issues, dismissed the suit without allowing full evidence to be presented. This decision was upheld on appeal. The petitioners then approached the Balochistan High Court, arguing they were denied a chance to present evidence and that lower courts had ignored old revenue records supporting their ownership claim.
The High Court dismissed the revision petition, agreeing with the lower courts. It found that revenue records actually showed the land was registered in the name of the Provincial Government, not the petitioners. No formal allotment or ownership record existed in their favor. The court held that when a suit is fundamentally incompetent or unmaintainable, it can and should be dismissed early, without going through a full trial, to save time and expense. It relied on a Supreme Court precedent confirming that unclear or unsubstantiated ownership claims cannot support a suit for possession or declaration.
This case matters because it reinforces that courts can dismiss legally baseless claims at an early stage, and that unsupported ownership assertions cannot block public infrastructure projects like dam construction.
