This case is about a dispute over enforcing a court decree. The respondent had won an ex-parte judgment for specific performance from a Civil Judge in Abbottabad, ordering the appellant to fulfill an agreement. The respondent then sought to execute that decree, and the execution proceedings were transferred to a court in Quetta, since that is where the property and the appellant were located. Instead of simply objecting to how the decree was being executed, the appellant tried to challenge the original judgment itself, arguing that the Abbottabad court never had jurisdiction (since the property was in Quetta) and that the decree had been obtained through fraud. The Quetta court refused to entertain these objections, and the appellant appealed.
The Balochistan High Court upheld that refusal. It explained that under the law governing transferred decrees, a court merely executing a decree transferred to it cannot go behind that decree, cannot reverse or review the original judgment, and cannot rule on whether the original court had jurisdiction or acted properly. Its role is limited to deciding matters of execution, and only questions about its own jurisdiction to execute. The court also discussed the legal provision meant to let execution courts resolve disputes about carrying out a decree quickly, without forcing parties into separate lawsuits, but clarified that this doesn't extend to attacking the underlying judgment itself. The appeal was dismissed.
This case matters because it clarifies the limited powers of courts handling transferred decrees, preventing them from being used as a backdoor to challenge original judgments.
