Syed Ain Ulah and 4 others V. Dilbar and 2 others,
MLD 2013 708 · Balochistan High Court
This case involved a land dispute between family members, Ain Ulah and others (petitioners) against Dilbar and others (respondents), over ownership and possession of agricultural land in Pishin, Balochistan. The petitioners had filed a civil suit seeking a declaration of ownership, cancellation of a mutation entry (land record change) in someone else's name, and a permanent injunction. The trial court dismissed the suit, saying it lacked jurisdiction under the West Pakistan Land Revenue Act, 1967, and that necessary parties had not been included in the case. The District Judge upheld this dismissal on appeal.
The Balochistan High Court disagreed. It held that while the Land Revenue Act does restrict civil courts from hearing certain revenue matters, this restriction has exceptions, and the lower courts wrongly focused only on the general bar without considering those exceptions. The court also noted that revenue authorities had never actually decided the dispute, but had instead told the parties to go to civil court. Since real questions about land possession and entitlement remained unresolved, a civil court was the proper forum. The High Court also found the dismissal for non-joinder of parties improper, since procedural law allows courts to add necessary parties rather than throw out a case entirely.
As a result, the High Court set aside the lower courts' decisions and sent the case back for a proper trial on the merits, with evidence. This case reinforces that civil courts cannot dismiss land disputes purely on technical or jurisdictional grounds without examining the substance of the claims.

بلوچستان ہائی کورٹ نے اس سے اختلاف کیا۔ عدالت نے قرار دیا کہ اگرچہ لینڈ ریونیو ایکٹ دیوانی عدالتوں کو بعض ریونیو معاملات ک
