State v. Kalimullah,
MLD 2013 490 · Balochistan High Court
This case involved an appeal by the State against the acquittal of a man, Kalimullah, who had been accused of murdering his wife, Mst. Bibi Jamila, under section 302 of the Pakistan Penal Code. The prosecution alleged that he brutally beat her, causing internal injuries that led to a miscarriage and eventually her death.
The trial court had acquitted him, and the State challenged this before the Balochistan High Court. The High Court examined the evidence and found serious problems with the prosecution's case. There were no eyewitnesses to the alleged beating, and the witnesses who testified were closely related to the complainant and the deceased, making them interested and potentially biased. Their statements also contradicted each other on important points and showed signs of dishonest exaggeration.
Crucially, medical evidence did not support the murder allegation. The deceased's medical history showed abdominal pain, vomiting blood, and diarrhea, and doctors determined she died from kidney failure and blood infection, not from injuries. A medical examination found no external wounds or bruises on her body, aside from some scratched hair, and evidence about the hair was never sent for forensic testing.
The High Court upheld the acquittal, reaffirming the legal principle that an acquitted person enjoys a strengthened presumption of innocence, which can only be overturned if the original decision was clearly perverse, arbitrary, or illegal. Since the prosecution failed to prove guilt beyond doubt, the appeal was dismissed.
