MLD 2013 1482 · Balochistan High Court
This case involved a family dispute over a house in Quetta. The plaintiffs (later appellants) had been living in the house but lost a long legal battle over ownership, which the Supreme Court ultimately decided in favor of a woman named Hameeda Begum, declaring her the owner and the plaintiffs mere tenants. After that ruling, Hameeda Begum reportedly forced the plaintiffs out, throwing their belongings into the street and causing property damage. The plaintiffs then sued for damages of over two crore rupees, alleging harassment, false criminal cases, defamatory statements in court filings, and breach of an undertaking to return possession of the house.
The trial court dismissed the suit, and the plaintiffs appealed. However, during the case, Hameeda Begum died before any final decree was issued against her, and her legal heirs were never properly brought into the case. The High Court found this fatal to the appeal: since the claim for damages was a single, joint claim against all defendants together and could not be split up, the death of one defendant before judgment meant the entire suit had to fail equally against everyone, not just her.
The court dismissed the appeal, upholding the trial court's decision. The case illustrates an important legal principle: when a claim is "indivisible," the death of one defendant during litigation, without properly continuing the case against their heirs, can cause the whole suit to collapse.
