Muhammad Rabani and 5 others V. Agha Arshad through Imran Ali and another,

MLD 2013 1083 · Balochistan High Court

This case involved a property dispute where the plaintiff (Agha Arshad) sued for specific performance of a 2007 agreement and recovery of a large sum of money, also seeking an interim injunction to restrain the defendants from certain actions while the case was pending. The trial court granted this restraining order. The defendants, however, argued that since there was an arbitration clause in their agreement, the matter should be referred to an arbitrator, and filed an application under Section 34 of the Arbitration Act seeking to stay the court proceedings. They then appealed against the interim injunction, arguing the trial court should not have issued it while their request for arbitration was pending.

The Balochistan High Court dismissed the appeal. It held that merely filing an application to stay proceedings and refer a dispute to arbitration does not stop a trial court from separately deciding an injunction application, since arbitrators have no power to grant such interim relief under the law. The court clarified that the legal phrase barring a party from taking "any other step in the proceedings" after invoking arbitration refers only to steps in the main case, not to actions taken regarding interim applications like injunctions.

This ruling matters because it clarifies that courts retain authority to protect the subject matter of a dispute through interim orders even when arbitration is sought, ensuring one party cannot cause irreversible harm to the other while arbitration proceedings are being arranged.
