Haji Wahid Bakhsh V. Ahmed and 2 others,
MLD 2013 1039 · Balochistan High Court
This case involves a property and money dispute from Gwadar. Haji Wahid Bakhsh sued three people, claiming the second and third respondents owed him Rs. 1,000,000 for a launch (boat) purchase and cash given to them. He alleged that the first respondent had guaranteed this debt through a 1997 agreement, promising to hand over two shops if the debt wasn't paid, and that he later took possession of the shops and was collecting rent from tenants.
The case went through multiple courts over many years, including the Qazi's court, a religious appellate body (Majlis-e-Shoora), and a previous round before the High Court, which had already sent the case back for the trial court to rewrite its judgment properly. Eventually, the Senior Civil Judge dismissed the suit, and the plaintiff appealed again.
The High Court upheld the dismissal. It found that the key agreement document was never properly proved: its author (the person who supposedly signed it) was alive but never brought to testify, only a photocopy was produced instead of the original, and the document required registration which had not been done. The court also found that the evidence given did not match the claims made in the plaint. Since there was no error in how the trial court had read the evidence, the appeal was dismissed with costs.
The case highlights how important it is to properly prove documents in court, especially originals and witness testimony, when claiming rights based on an agreement.
