Mohi-ud-Din v. Muhammad Iftikhar Siddique,

MLD 2012 673 · Balochistan High Court

Mohi-ud-Din bought a house in Quetta and took possession of it, claiming to be the lawful purchaser through a proper sale. Muhammad Iftikhar Siddique filed a complaint under the Illegal Dispossession Act, 2005, alleging that he was the rightful heir and occupant of the same property since 1961, and that Mohi-ud-Din and another person had illegally broken the locks and taken over the house while he was away. The trial court (Sessions Judge, Quetta) accepted the complainant's request for interim relief and ordered the property restored to him, relying mainly on a police report that supported the complainant's version, and on the fact that the petitioner had not produced ownership documents.

Mohi-ud-Din challenged this order before the Balochistan High Court, arguing he was never given notice or a chance to be heard, that the trial had not even begun, and that the police report relied upon came from the wrong police station, one that had no jurisdiction over the area where the house was actually located.

The High Court agreed with the petitioner. It held that since he was in possession of the property, he had a right to be heard before being dispossessed, and that the trial court wrongly relied on a report from an unrelated police station whose officer was actually a party to the case. Because these legal requirements were ignored, the court set aside the restoration order and accepted the revision petition, sending the matter back for proper process.

محی الدین نے اس حکم کو بلوچستان ہائی کورٹ میں چیلنج کیا اور دلیل دی کہ اسے کبھی نوٹس نہیں دیا گیا اور نہ ہی سنے جانے کا موقع دیا گیا،
