Muhammad & others v. Muhammad,
MLD 2012 63 · Balochistan High Court
This case involved a long-running property dispute over a piece of land in Balochistan. The plaintiffs claimed they owned and possessed the land, alleging that the defendant was unlawfully interfering with it. However, the plaintiffs own pleadings revealed a different story: the land had actually been given by their deceased brother to the defendant for cultivation, on condition that the defendant pay Rs.10,000 and build an embankment at his own cost. The defendant complied with these terms while the brother was alive but later stopped.
The case had gone back and forth multiple times between the trial court (Qazi Awaran) and the appellate forum (Majlis-e-Shoora Khuzdar), with several remands and reversals. Eventually, the trial court ruled in favor of the plaintiffs, but the appellate court overturned that decision and dismissed their suit. The plaintiffs then challenged this in the Balochistan High Court through a civil revision petition.
The High Court dismissed the revision petition, agreeing with the appellate court. It found that since the plaintiffs case actually described a conditional arrangement or agreement rather than straightforward ownership, they should have filed a suit for specific performance of that agreement, not a simple declaration of title. The court also noted that the plaintiffs lawyer failed to properly produce or reference key witness statements from the later stages of the case.
This judgment highlights an important legal principle: when a claim is really based on an agreement with conditions, the correct remedy is to seek enforcement of that agreement, not a declaration of ownership.
