Mst. Jamila Nargis v. Secretary to the Government of Pakistan,

MLD 2012 466 · Balochistan High Court

This case concerns a long-running dispute over a shop built on a plot in Quetta that had originally been allotted to the petitioner's father-in-law by the Evacuee Trust Property authorities after the property was left vacant following Partition. He built a shop there and rented it to a tenant. Years later, in 1976, authorities wrongly allotted the shop itself to that tenant's family without proper survey. This transfer was challenged through the courts, and in 1998 the Supreme Court of Pakistan finally ruled in favour of the original allottee's side, dismissing the tenant family's claim.

After her husband died in 1992, the petitioner applied to have the tenancy of the shop restored in her name, and this was granted. However, nearly a decade later, the tenant's successors objected, arguing that under the 1977 Scheme governing evacuee trust properties, the tenancy could not legally be transferred to her. Government authorities accepted this objection, cancelled her tenancy, and ordered the shop to be auctioned instead.

The Balochistan High Court found that this reversal ignored the Supreme Court's earlier binding decision and had no legal basis, since the matter had already been conclusively settled. The court set aside the orders cancelling her tenancy and directed that the shop be vacated from the private respondents and handed back to the petitioner. The judgment reinforces the principle that disputes should be decided on their merits, and that parties should not be allowed to exploit technicalities to defeat settled judicial decisions.
