Mullah Gul Muhammad v. The State,
MLD 2012 401 · Balochistan High Court
This case involved a tragic incident in April 2009 where a container truck traveling from Afghanistan to Pakistan was found parked near Quetta with dozens of Afghan nationals trapped inside, most of them dead from suffocation. The victims had allegedly been trafficked for forced labor. An FIR was registered, but the appellant, Mullah Gul Muhammad, was not named in it. He was implicated later, based on statements by surviving victims who identified him for the first time in court, allegedly as the owner of a hotel from which the victims had been loaded onto the container. The trial court convicted him under sections 322 and 337-L(2) of the Pakistan Penal Code, sentencing him to pay compensation (Diyat) to victims' families and to two years' imprisonment.
On appeal, the Balochistan High Court overturned the conviction. The judge found that no identification parade had been conducted after his arrest, and the witnesses were not previously familiar with him, meaning their courtroom identification alone was unreliable and needed corroboration that was missing. The investigating officer had also failed to gather key evidence, and the prosecution never actually proved the appellant owned or ran the hotel in question. Given these serious gaps, the court held the prosecution failed to connect him to the crime and acquitted him, granting the benefit of the doubt.
This case highlights the importance of proper identification procedures and solid evidence in criminal trials, especially when an accused is not named in the original police report.
