Gul Muhammad v. Dost Muhammad,
MLD 2012 365 · Balochistan High Court
This case involved a dispute over the registration of a criminal case. The petitioner, Gul Muhammad, alleged that respondents came armed to a village, opened fire, killing one man and injuring another. He claimed he reported this to the police, but the station house officer refused to register an FIR. He then approached the Sessions Judge, acting as Justice of Peace, under section 22-A of the Criminal Procedure Code, asking that police be directed to register the case. The Sessions Judge dismissed his application, and Gul Muhammad challenged that dismissal before the Balochistan High Court.
The High Court dismissed the petition. It held that a Justice of Peace has limited power: only to check whether the information given discloses a cognizable offence, not to investigate the truth of the allegations. However, the Court found the Sessions Judge's order was well-reasoned, noting that neither the deceased's family nor the injured person had come forward to support the petitioner's version, that the petitioner himself had no direct connection to the incident, and that he filed his application after an unexplained three-month delay while concealing relevant facts, including that those involved were linked to prior criminal cases.
The judgment clarifies the limited, non-investigative role of the Justice of Peace and confirms that courts will not interfere with well-reasoned orders unless there is a clear failure to apply judicial mind, especially where the applicant appears to be acting with delay or hidden motives.
