Shah Nawaz and 2 others V. The State,
MLD 2012 325 · Balochistan High Court
This case involves an appeal against convictions for murder under Pakistan's Penal Code. Shah Nawaz, Gul Nawaz, and Muhammad Nawaz had been convicted by a Sessions Judge for the killing of Zulfiqar Ali, with two receiving life imprisonment and one receiving 14 years plus compensation to the victim's family. They appealed to the Balochistan High Court.
The prosecution's case relied mainly on the testimony of two eyewitnesses, one the deceased's cousin and the other his brother. The High Court found this evidence deeply flawed: the witnesses were closely related to the victim and had a motive to be biased against the accused, their behavior during the alleged incident was suspicious since they made no effort to save the victim or catch the attackers despite being equal in number, and the crime occurred at night with no independent witnesses. The court also noted that the alleged murder weapon was never sent for forensic testing, so there was no scientific proof it was actually used in the killing. Additionally, the prosecution failed to prove the motive it had itself alleged.
Given these serious gaps, the court ruled that the evidence was not strong enough to sustain a conviction, especially for such a serious charge carrying capital punishment. The court set aside the convictions and sentences, acquitting and ordering the release of all three appellants. This case highlights how Pakistani courts require solid, corroborated evidence before convicting someone of murder, particularly when witnesses have personal relationships with the victim that could affect their reliability.
