National Highway Authority through General Manager V. Mehrullah Khan and another,
MLD 2012 32 · Balochistan High Court
This case involved a dispute over compensation for land acquired by the National Highway Authority to build a road. The landowner, unhappy with the compensation awarded by revenue authorities, filed a reference before the Additional District Judge, Kalat, who increased the compensation. The National Highway Authority then appealed to the Balochistan High Court, arguing that the trial court's decision was flawed because it did not follow proper procedure under the Civil Procedure Code.
Two issues arose. First, the landowner argued the Authority had no legal right to appeal, claiming only the Provincial Government could do so under the Land Acquisition Act. The High Court rejected this, noting that a 2000 amendment to the law in Balochistan extended the right to appeal to the Federal Government, Provincial Government, companies, or local authorities acting as acquiring bodies - so the Authority's appeal was valid.
Second, on the merits, the High Court found that the trial court had failed to frame proper legal issues or record evidence before deciding the case, as required by procedural rules (Order XX, Rule 5 of the Civil Procedure Code). This made the trial court's judgment legally defective.
As a result, the High Court set aside the trial court's order and sent the case back for a fresh decision, directing that issues be properly framed, evidence recorded, and parties heard, ideally within six months. The case highlights the importance of following proper court procedure even in land compensation disputes.
