Mir Hazar Khan v. The State,

MLD 2012 285 · Balochistan High Court

Mir Hazar Khan was tried and convicted under section 9(c) of the Control of Narcotic Substances Act, 1997, for possessing a large quantity of charas (140 kg baked and 19 kg raw), along with arms, ammunition, and walky-talkies, allegedly recovered from a hidden basement in his house in Killi Turkaman, Dasht, Balochistan, following a police raid based on informer tips. The Special Judge sentenced him to life imprisonment plus a fine, giving him benefit for time already served. He appealed to the Balochistan High Court, arguing that the recovery was actually from a house he didn't own or control, that his confessional statement was recorded after a suspicious 15-day delay, that police failed to get a search warrant despite prior information, and that the trial court wrongly ignored favorable testimony from a hostile witness.

The High Court rejected all these arguments. It found that the prosecution's witnesses were consistent and credible despite lengthy cross-examination, and that the combination of the accused's own disclosure statement, his recorded confession, and the physical recovery of drugs and weapons from his conscious possession proved guilt beyond reasonable doubt. The court also clarified an important evidentiary principle: testimony from a "hostile" witness (one who partly contradicts the prosecution) isn't automatically thrown out entirely - if parts of it are supported by other evidence, those parts can still be relied upon. The appeal was dismissed and the conviction upheld.
