Shah Mir and 6 others V. Ghulam Hussain,

MLD 2012 224 · Balochistan High Court

This case involved a dispute over tenants living in houses in Quetta since 1965. In 1993, Ghulam Hussain bought the property and later filed a petition to evict the tenants, claiming they had stopped paying rent since the purchase and that he genuinely needed the houses for his own family's use. The tenants argued the sale was fraudulent, that he never properly notified them of the change in ownership, and that he did not truly need the property, especially since he was not the sole owner.

The Balochistan High Court upheld the eviction order. It found that the landlord's need was genuine, as he was living in a crowded joint household with his brothers and five grown children, and the tenants failed to disprove this. On the notice issue, the court ruled that even without formal notice, the act of filing the eviction petition itself served as notice, making the tenants liable for rent from the date ownership changed hands - and since they admittedly hadn't paid, they were in default. The court also clarified that questions of ownership or title are not the concern of rent proceedings; what matters is the landlord-tenant relationship. A co-owner can file for eviction without needing permission from other co-owners.

This judgment reinforces settled principles under rent laws: tenants cannot use ownership disputes to escape eviction once a landlord-tenant relationship and rent default are established, and silence on notice does not shield tenants from consequences of non-payment.
