Saleh Muhammad v. Baz Muhammad,

MLD 2012 1907 · Balochistan High Court

This case involved a dispute over land in Quetta. In 2007, Baz Muhammad claimed he had never signed a power of attorney dated 1977, which his father Ghulam Nabi had used to transfer property through official mutation entries. Baz Muhammad wanted these mutations cancelled, alleging forgery, even though the power of attorney was thirty years old, his father (the alleged attorney-holder) had died eighteen years earlier, and it had been duly registered.

Revenue officials initially rejected his complaint after confirming the document was properly registered. However, on appeal, the Land Commissioner accepted his claim, declared the power of attorney void, and cancelled the original mutation along with all subsequent mutations and sale deeds based on it. This was upheld by the Board of Revenue.

The Balochistan High Court found this to be a serious legal error. It held that revenue authorities like the Land Commissioner have no jurisdiction to declare a registered power of attorney forged or void, or to cancel mutations and sale deeds on that basis—only a competent civil court can do so. Mutation entries are for tax/fiscal record-keeping only and don't establish ownership. Since a thirty-year-old registered document enjoys a presumption of validity, only a civil court, after a proper trial, could decide whether it was genuine.

The High Court therefore intervened using its constitutional jurisdiction to correct this jurisdictional overreach, emphasizing that revenue officers cannot decide complex property title disputes reserved for civil courts.
