Abdul Samad v. Govt: of Balochistan & others,
MLD 2012 1898 · Balochistan High Court
This case involved a property dispute over land and a house in Mouza Soorab, Balochistan. The petitioners claimed the property was their ancestral land, held in their family's possession for 70-80 years, originally acquired by their forefather who had worked in the Buildings and Roads (B&R) Department. They said revenue records had wrongly listed the government as owner instead of them. The government contested this, arguing the land belonged to it and that the petitioners' father had lived there merely as a chowkidar (caretaker/watchman) with permission, not as an owner.
The trial court initially ruled in favor of the petitioners, but on appeal, the appellate court reversed this decision and dismissed their suit. The petitioners then filed this revision petition before the Balochistan High Court.
The High Court upheld the appellate court's decision. It found that the petitioners' witnesses gave inconsistent, incomplete, or hearsay testimony, often failing to correctly describe the property's boundaries or Khasra (survey) numbers.
