M Afzal Alias Mazel & ors v. Haji Haq Dad & others.,
MLD 2012 1627 · Balochistan High Court
This case involved a property dispute in Pishin, Balochistan, over ownership and possession of a room and land in a residential area. The plaintiffs claimed they had bought a room from a man named Naik Muhammad, and that they were in possession of a piece of land, but the defendants disputed their ownership and even filed complaints with local authorities claiming the land for themselves. The plaintiffs sued for a declaration of ownership and an injunction to protect their rights.
Both the trial court and the first appellate court ruled in favor of the plaintiffs after examining witness testimony from both sides. The defendants then approached the Balochistan High Court, arguing that the lower courts had misread the evidence and failed to properly apply procedural rules under the Civil Procedure Code.
The High Court dismissed the revision petition. It held that the defendants had not shown any specific illegality, irregularity, or misreading of evidence in the lower courts' decisions—merely making general objections was not enough. The court reaffirmed the well-established principle that when two lower courts reach the same factual conclusion (concurrent findings), the High Court will not interfere unless there is clear proof that the evidence was misread or ignored.
This case is significant because it illustrates how Pakistani courts limit interference in revision petitions, protecting the finality of factual findings unless a genuine legal error is demonstrated.
