Ameer Bakhsh alias Mumtaz Ali and 2 others V. The State,

MLD 2012 158 · Balochistan High Court

This is a murder appeal from the Balochistan High Court. Three men, Ameer Bakhsh, Inayatullah, and Ahmed Sultan, had been convicted by a trial court and sentenced to life imprisonment for the murders of three people, allegedly killed by gunfire during a nighttime incident in December 2006. They appealed their conviction.

The High Court re-examined the evidence and found it seriously lacking. The main prosecution witnesses were close relatives of the deceased, making them potentially biased, and their accounts were inconsistent and uncorroborated. Several key witnesses, including the complainant himself, had turned hostile and did not support the prosecution's version. One witness could not even establish that he was present at the scene. The FIR was filed 4-5 hours after the incident without explanation, and it did not name the witnesses who later testified. No weapons were recovered from the accused, and no ballistic report linked them to the crime.

Given these gaps, the court ruled that the prosecution failed to prove its case beyond reasonable doubt. It held that even a single reasonable doubt must benefit the accused, and acquitted all three men, setting aside their convictions and ordering their release.

This case matters because it reinforces a fundamental principle of criminal justice: the burden of proof lies entirely on the prosecution, and convictions cannot stand on weak, interested, or unsupported testimony, especially in serious cases carrying life sentences.
