Mahmood Ahmed v. The State,

MLD 2012 1433 · Balochistan High Court

This case is about a man convicted of possessing an unlicensed pistol under the West Pakistan Arms Ordinance, 1965. The prosecution claimed that while the appellant was in custody for a separate murder case, he confessed and led police to a hidden pistol behind a cabin in Quetta, resulting in the recovery of the weapon along with cartridges. Because he could not produce a license for the pistol, he was charged, tried, and convicted by a trial court, receiving three years' rigorous imprisonment and a fine.

On appeal, the Balochistan High Court found serious flaws in how the case was investigated and proved. The actual disclosure memo (the document recording the accused's confession and pointing out the weapon's location) and the seizure memo were never properly produced as evidence, and no witness verified them in court. The trial court had simply accepted the prosecution's assertions as fact without examining the actual record. Key witnesses did not properly support the recovery process, and evidence from a separate case file was relied upon without formally placing it on record, which the court said was legally impermissible.

Because of these gaps and contradictions, the High Court held that the prosecution had failed to prove its case beyond reasonable doubt. Following the principle that any doubt in a criminal case must benefit the accused, the court set aside the conviction and acquitted the appellant, ordering his release. The case highlights the importance of proper evidence handling and documentation in criminal trials, especially regarding confessions and recoveries made during police investigations.
