Patoo v State,
MLD 2012 1358 · Balochistan High Court
This case involved two brothers, Patoo and Moula Baldish, who were convicted by a trial court in Lasbela and sentenced to life imprisonment for the murder of a man named Din Muhammad in 1986. The prosecution's case rested mainly on a dying declaration (the victim naming the accused before he died), alleged confessions recorded before a magistrate, and recovery of weapons like an axe and knife.
The Balochistan High Court overturned the conviction and acquitted both men. It found the prosecution's evidence riddled with serious problems: the main witness contradicted his own police statement and improved his account in court; no identification parade was held to confirm who the attacker was; a key witness never actually identified the accused; and the dying declaration, which is inherently weak evidence needing independent support, had none. The recovery of the weapons was not properly linked to the accused, there was no chemical report confirming blood on the axe, and the motive was never clearly established.
Most importantly, the confessions were recorded far from where the accused were held, with no explanation for moving them, and the magistrate failed to follow the mandatory legal procedure under the Criminal Procedure Code for recording confessions safely and voluntarily.
Because of these combined doubts, the court ruled the prosecution failed to prove guilt beyond reasonable doubt, and the accused deserved the benefit of that doubt. This case underscores the strict safeguards required for confessions and dying declarations to be legally reliable.
