Shafi Muhammad v. the State,
MLD 2012 134 · Balochistan High Court
This case involved two men, Shafi Muhammad and Akbar, who had been convicted and sentenced under the Pakistan Arms Ordinance. They had appealed these convictions to the Balochistan High Court, but their lawyer withdrew the appeals, telling the court they were "not pressed," apparently under the mistaken belief that the men had already served their sentences (having been acquitted separately in a related murder case). Later it turned out they still had significant jail time left, so they asked the High Court to review its own order dismissing their appeals, hoping to have the appeals heard properly or get reduced sentences.
The High Court refused. It explained that under Section 369 of the Criminal Procedure Code, once a court signs and pronounces a judgment, it cannot alter or review it, except to fix minor clerical mistakes. This rule applies even to the High Court. The court also rejected the argument that its inherent powers under Section 561-A could be used to get around this bar, clarifying that those powers help enforce the law or prevent injustice but cannot be used to change a final decision already made.
This matters because it reinforces the important legal principle of finality in criminal judgments—once a court rules, that decision generally stands, even if a lawyer's mistake led to an unfavorable outcome, except in narrow circumstances involving genuine clerical errors.
