Bohair Qazi and others V. The State,
MLD 2012 1205 · Balochistan High Court
This case is about a man named Bohair Qazi, who was accused in several criminal cases involving robbery and related offences under the Pakistan Penal Code. He was in jail custody but had suffered a severe leg injury that led to gangrene, a serious and potentially life-threatening condition where body tissue dies due to poor blood supply. His leg had already been partly amputated, and doctors recommended further specialized treatment, including possible surgery in Karachi or abroad, which was not available in the jail hospital.
His bail applications had earlier been rejected by the trial court on the ground that he had not surrendered and was considered a "fugitive from law." He then approached the Balochistan High Court seeking bail purely on medical grounds.
The High Court examined medical certificates confirming the seriousness of his condition and ruled that continued detention in jail, where proper treatment was not possible, posed a direct threat to his life. Relying on precedents from the Supreme Court, the judge held that bail cannot be treated as punishment, and that when an accused suffers from a disease that cannot be treated in jail and endangers his life, he is entitled to bail on medical grounds.
The court granted him bail in all the connected cases. This judgment reaffirms the principle that health and human life must be protected even for undertrial prisoners, and that bail on medical grounds is a legitimate legal remedy, not an exception to punishment.
