Azizullah v. The State,

MLD 2011 950 · Balochistan High Court

This case is about whether a criminal complaint over a shooting should be tried in a regular Sessions Court or transferred to a special Anti-Terrorism Court. The complainant, Azizullah, reported that on 5 August 2009 armed men opened fire with a Kalashnikov on his brothers along the Quetta-Chaman Road, killing one and seriously injuring the other. The accused remained absconding, and the case was pending trial before an Additional Sessions Judge. Azizullah asked the High Court to transfer the case to the Anti-Terrorism Court, arguing that the crime happened on a main highway, caused public fear and panic, and therefore amounted to terrorism under the Anti-Terrorism Act, 1997, even though the police had not originally charged the accused under that law.

The Balochistan High Court examined the legal definition of terrorism under Section 6 of the Anti-Terrorism Act, which requires that an act not only cause death or injury but also be intended to intimidate, coerce or create fear among the government, public, or a section of society. The court found that although the incident tragically caused death and injury, it stemmed from personal enmity between the two families, as stated in the FIR itself. There was no evidence that the act was meant to spread fear or intimidate the wider public or any community. Since the essential element of terrorism—intimidation or overawing the public—was missing, the court dismissed the application to transfer the case, ruling it should remain a matter for the ordinary criminal court rather than a special anti-terrorism proceeding.
