Abdul Razzaq v. Jameel Ahmed,

MLD 2011 76 · Balochistan High Court

This case is about a landlord-tenant dispute in Quetta over a house on Gurdat Singh Road. The original owner, Noor Ahmed, had rented the house to Abdul Razzaq. After Noor Ahmed's death, his son Jameel Ahmed sought to evict the tenant, claiming rent default and that he personally needed the house.

The tenant admitted he was a tenant but disputed the rent amount and claimed the landlord's father had refused to accept rent, so he had been depositing it in court since 1999. He also tried to argue there had been a sale transaction giving him ownership, though the trial court rejected this, and the High Court agreed it could not decide ownership questions in rent proceedings.

The Balochistan High Court ruled in favor of the tenant. It found that the son, as heir, did qualify as "landlord" under the law, but since the property was residential, the landlord needed special permission from the Rent Controller to convert it for commercial use, which he had not obtained—so the claim of "personal need" failed. Crucially, the court also found the landlord never gave the tenant formal notice of the change of ownership after his father's death, as required by law. Without such notice, the tenant could not be blamed for not paying rent to the new owner, so there was no legal default.

As a result, the eviction order was set aside and the appeal was accepted. The case highlights that landlords must follow proper legal procedures—like notifying tenants of ownership changes and obtaining permission before converting property use—before seeking eviction.
