Ilyas v. The State,

MLD 2011 712 · Balochistan High Court

This appeal concerns two men, Ilyas and another accused, who were convicted by a Sessions Court in Turbat for robbery (theft with violence) under sections 392 and 34 of the Pakistan Penal Code. They were sentenced to four years' rigorous imprisonment plus fines. The prosecution's case was that they had stopped the complainant and his uncle on a motorcycle, demanded the bike, assaulted the complainant with a pistol butt, and fled with the motorcycle.

The Balochistan High Court, however, found serious flaws in the prosecution's evidence. There was unexplained delay both in filing the police report and in recording witness statements, as well as delay in inspecting the crime scene. No stolen motorcycle or weapon was ever recovered. The medical evidence did not match the witnesses' account of events, and the sequence of events described by the prosecution did not make logical sense. The court also questioned why the complainant would pursue a compromise with the accused after suffering violent injuries during a robbery, finding this unexplained.

Because of these contradictions and gaps, the court held that the essential elements of the robbery offence had not been properly proven, and the trial court had failed to consider these discrepancies. Applying the principle that any reasonable doubt must benefit the accused, the High Court overturned the conviction and acquitted both men. The case illustrates how courts scrutinize inconsistencies and unexplained delays in criminal prosecutions before allowing a conviction to stand.
