Nasir Hameed v. Rais Muhammad Akram,

MLD 2011 587 · Balochistan High Court

This case involved a property dispute where the original plaintiffs (Rais Muhammad Akram and others) had filed a lawsuit seeking a court declaration of their ownership title, a permanent injunction, and correction of entries in official revenue records. The trial court dismissed their suit at an early stage, ruling it was filed too late (barred by limitation) without hearing full evidence from both sides.

The plaintiffs appealed, and the appellate court (Majlis-e-Shoora Mastung) overturned that dismissal, sending the case back to the trial court with instructions to properly frame factual issues, take evidence from both parties, and then decide the case on its merits. The petitioners (who were defendants in the original suit) challenged this decision before the Balochistan High Court, arguing the trial court had correctly handled the matter as a pure legal question that could be decided through arguments alone.

The High Court disagreed and upheld the appellate court's decision. It explained that under civil procedure rules, when a case involves purely legal issues, courts can decide them by hearing arguments alone. However, when legal questions are intertwined with disputed facts, such as whether a landlord-tenant relationship existed or whether limitation periods applied, courts must record evidence before ruling, since these are "mixed questions of law and fact." The court found no error in sending the case back for a full trial with evidence. This ruling matters because it clarifies that courts cannot shortcut factual disputes disguised as legal questions, protecting parties' rights to have evidence properly examined.
