Muhammad Azam v. The State,
MLD 2011 470 · Balochistan High Court
This case arose from a murder trial involving the killing of two young men. Two eyewitnesses, Mst. Rubina and Mst. Afsana, had given earlier statements to a Judicial Magistrate before the trial began, but when they testified in court, they changed their accounts, effectively contradicting their previous statements. Despite this, the Assistant District Attorney handling the prosecution failed to declare them hostile witnesses or confront them with their earlier statements. The complainant then asked the trial court to recall these two witnesses so they could be properly questioned and cross-examined about the inconsistencies. The trial court refused, reasoning that the prosecution should not be allowed to fix its own mistakes at this late stage.
The Balochistan High Court disagreed and overturned that decision. It held that Section 540 of the Criminal Procedure Code gives courts wide powers to summon, recall, and re-examine witnesses at any stage of a trial if their evidence is essential to reaching a just decision. The court found that since these two women were key eyewitnesses to a serious crime, and their statements appeared to have changed, fairness required that they be recalled and confronted with their earlier statements so the truth could be established.
This ruling matters because it reinforces that trial courts have a duty to actively ensure justice is done, not just to rely on the lawyers' conduct, especially when key witnesses in serious criminal cases like murder appear to contradict themselves.
