Haji Abdul Rahim v State,
MLD 2011 1819 · Balochistan High Court
This case involved a man convicted for possessing a large quantity of opium (15.5 kg), along with unlicensed weapons and liquor, recovered from a room (Baitak) attached to his house in Quetta. Acting on a tip-off, an Anti-Narcotics Force team raided the premises at night without first obtaining a search warrant and found opium hidden in a plastic bag, along with a Kalashnikov rifle, ammunition, and beer. He was tried and sentenced by the Special Judge for Narcotics to life imprisonment and a fine.
On appeal, his lawyers argued the charge was flawed, ownership of the house was never proven, the raid lacked a search warrant despite there being time to get one, and the drug analysis report was unreliable since it didn't specify who submitted the samples for testing.
The Balochistan High Court rejected all these arguments. It held that the law allows officers to search and arrest without warrants in such cases, that the requirement to obtain warrants is only directory, and that the prosecution's witnesses gave consistent testimony. It also noted that under the Control of Narcotic Substances Act, once contraband is found in someone's possession, the burden shifts to the accused to prove innocence — which he failed to do. His defense was found to be inconsistent and untrustworthy, with no evidence of false implication. The court therefore upheld the conviction and life sentence.
This case illustrates how courts apply the presumption of guilt in drug possession cases and clarifies when police search procedures, even if imperfect, do not inval
